About
Evan Schein is a partner with Berkman Bottger Newman & Schein. He leads the firm’s litigation practice, leading a team of 28 highly regarded matrimonial attorneys.
Mr. Schein is a recognized authority on matrimonial law and litigation in New York State, with a practice focusing on issues that arise in high-net-worth and high-income divorces, as well as high-conflict child custody matters. As an experienced litigator who has tried many divorce cases and family law matters from inception through final decision, Mr. Schein is able to craft legal strategies unique to each set of facts and make strategic and tactical decisions that best represent a client’s interests. His cases have resulted in reported decisions that have broken legal ground, and he has regularly represented business owners, doctors, attorneys, financial professionals, corporate executives, and high-profile individuals, as well as their spouses. In addition to his litigation work, Mr. Schein is also frequently retained to negotiate prenuptial and postnuptial agreements.
Mr. Schein is regularly sought out for comment on matters of family law by media outlets, and has been quoted in Forbes, Newsweek, Law.com, the New York Post, the Daily Mail, and more. He is an adjunct professor at Benjamin N. Cardozo School of Law where he teaches the Divorce Process course with his law partner, Jacqueline Newman.
Mr. Schein also leads the firm’s family law and sports practice, which focuses on representing professional athletes in family law matters. Prior to becoming a divorce attorney, Mr. Schein was a sports agent. His familiarity with athlete contracts and complex compensation structures, endorsement, and marketing deals, allows him to provide highly specialized family law legal representation to clients in the sports and entertainment industries. He frequently works with sports and entertainment agents, business managers, prominent trust and estate attorneys, and financial advisors.
Mr. Schein has been recognized in the New York Metro Super Lawyers Edition since 2013, and in Best Lawyers since 2023. He sits on the faculty of the New York College of Matrimonial Trial Attorneys, has taught several Continuing Legal Education seminars for various organizations and bar associations in New York and nationally, and has been cited in publications for his work on prominent New York family law cases. He has achieved the top rating of 10 at Avvo, the prominent attorney-ranking database. Mr. Schein was previously selected for inclusion in the Westchester Business Council’s prestigious 40 Under 40 list.
Mr. Schein is also the host of the Schein On podcast, where he holds in-depth interviews with judges, psychotherapists, authors, athletes, filmmakers, and divorce professionals, on topics like the psychology of divorce; how to best help kids going through divorce; new developments in the law; and surviving a divorce with finances intact.
Mr. Schein is an active member of many organizations and bar associations including the New York State Bar Association (Family Law Section, Sports and Entertainment Law Section and Executive Committee); New York County Bar Association (Family Law Section); New York State Women’s Bar Association; American Bar Association (Family Law Section); and the Westchester County Bar Association.
